Welcome to 30Dare! These Terms and Conditions (“Terms”) govern your access to and use of the 30Dare mobile application and services (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of those changes.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable laws
  • Your registration information is accurate and complete

If you are under 18, you represent that you have obtained permission from your parent or legal guardian to use the Service.

  • Impersonate another person or entity
  • Transmit viruses, malware, or harmful code
  • Attempt to gain unauthorized access to the Service
  • Scrape, data mine, or use automated tools without permission
  • Reverse engineer or decompile the app
  • Use the Service for commercial purposes without authorization

5. User Content

5.1 Your Content

You retain ownership of all content you create, upload, or share through the Service (“User Content”). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.

5.2 Content Standards

All User Content must:

  • Comply with applicable laws and regulations
  • Not infringe on intellectual property rights
  • Not contain hate speech, threats, or harassment
  • Not include explicit or adult content
  • Not promote illegal activities

5.3 Content Monitoring

We reserve the right (but have no obligation) to monitor, review, and remove User Content that violates these Terms or is otherwise objectionable. We are not responsible for User Content posted by others.

The Service, including all content, features, and functionality, is owned by 30Dare and is protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or create derivative works of the Service
  • Use our trademarks or branding without permission
  • Remove or alter any copyright or proprietary notices

7.1 Premium Services

30Dare offers a premium one-time payment services.

7.2 Billing

  • You authorize us to charge your payment method
  • Prices are subject to change with notice

7.3 Cancellation

You may delete your account at anytime through your account settings or the app store.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of content

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 30DARE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or goodwill
  • Service interruptions or data loss
  • Actions or content of third parties
  • Unauthorized access to your account or data

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless 30Dare and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of others

11. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial or to participate in a class action lawsuit.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

13. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting a notice in the app or sending an email. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
